"Prosecutors say officials of the DEA and FDA and members of Congress warned FedEx at least six times since 2004 that illegal Internet pharmacies used the global shipper to deliver drugs.

The indictment says FedEx knowingly shipped drugs for two illegal Internet pharmacies, the Chhabra-Smoley Organization and Superior Drugs. In 2003, the DEA shut down RxNetwork, one of the Chhabra-Smoley businesses, and arrested Vincent Chhabra on charges of violating the Controlled Substances Act."

California HMDR Exemptee Training Requirements

Q.  I'm submitting an application for a Home Medical Device Retailer (HMDR) Exemptee license, as a new applicant. What are the things that I need to pay attention to, regarding training requirements?

A.  According to the referenced CDPH HMDR license application form:
  • New applicants must meet minimum qualifications, including proof of completing a training program (that addresses 5 topic areas).
  • In order to prove training completion, the applicant must submit a copy of the completed training certificate (or transcript).
  • Specifically, in the Minimum Qualifications - Training Programs section: Indicate by yes or no the training you have completed specific to the five topics listed. Attach copies of certificates or transcripts.
Be forewarned, the application states, "Unsigned or incomplete applications cannot be processed and will be returned."

"The Home Medical Device Retailer (HMDR) licensing program is administered as part of the Medical Device Safety and Youth Tobacco Enforcement Section and is governed by law sections found in the California Sherman Food, Drug and Cosmetic Law.  The Sherman Law was amended in the 1999-2000 legislative session to establish the HMDR licensing program.  This section of the Sherman Law can be found by following the link below.  It is in the Adobe PDF format so you will need an Adobe reader program to open and print the document."

Will The CA e-Pedigree Dates Slip Again?

"In response to enactment of the [DSCSA] Act, the California Board of Pharmacy (Board) has issued a public notice stating that California's e-Pedigree provisions have been inactivated. The Board also noted that it will sponsor legislation this year to repeal the e-Pedigree provisions that have been inactivated."

Exemptee Must Be On Premises When Prescription Devices Are Being Dispensed

On the CDPH Application for Home Medical Device Retailer Exemptee License - New and Renewal (located on the CDPH HMDR Program webpage) there's a place for the Employer to certify that:
". . . it is my understanding that a person certified by the Food and Drug Branch must be on the premises and actively supervising operations at all times when prescription devices are being dispensed."

The Associated Press: Cardinal Health ends DEA inquiry with settlement:

"Pharmaceutical wholesaler Cardinal Health Inc. said Tuesday one of its Florida facilities will be barred from shipping controlled substances for two years under a settlement with federal authorities over alleged ineffective controls.

The Lakeland, Fla., facility will remain open and other operations will continue under the agreement with the Drug Enforcement Administration. Cardinal Health also intends to improve procedures that are designed to prevent prescription drugs from being abused.

The Dublin, Ohio, company said the DEA is not planning to take further actions against other Cardinal Health facilities."

No Significant Difference - Compares distance education to face-to-face

This body of research supports distance education as neither better or worse than face-to-face education.  Once you factor in cost and convenience, it would seem that online training is the big winner.

No Significant Difference - Presented by WCET:

"Does taking a course via distance education lower a student's chances for success as compared to the same student taking the same course in a face-to-face format?

Mr. Russell collected research studies addressing this question from as far back as 1928. The studies included in his collection involve a wide array of distance delivery modes including correspondence (printed materials sent out to students), radio, television, video, and online. Mr. Russell found that an overwhelming number of studies showed that when the course materials and teaching methodology were held constant, there were no significant differences (NSD) between student outcomes in a distance delivery course as compared to a face to face course. In other words, student outcomes in distance delivery courses were neither worse nor better than those in face to face courses. Mr. Russell referred to this collection of results as the "No Significant Difference Phenomenon", thus coining the now-common identifier phrase for this body of literature."

"Everybody wants to offer online e-learning solutions for their staff training and development needs. But not all e-learning is the same. E-learning should go beyond reading a book on a computer screen. Honestly, if I am going to read the words on a page I would rather be under a fluffy blanket, and be curled up on the couch with a pot of hot tea and some butter cookies. E-learning should make full use of the technology of the computer.
  • I want the instructor to talk to me, preferably, on the screen.
  • Add some pictures, or better yet, add some live action video and animation.
  • Provide some interaction to keep me fully engaged and challenged.
  • Provide a handout to go along with the course so I can use that as a memory jogger after I have completed the course.
  • E-learning developers, challenge yourself to go beyond republishing the text book on the computer screen.

Don't get tripped up.

Many folks are interested in becoming a California Home Medical Device Retailer (HMDR Exemptee.

However, it's easy to miss that the application states some minimum requirements about who is qualified to submit an application.

According to the California Application for Home Medical Device Retailer Exemptee License - New and Renewal form, these are the minimum qualifications:
  • Education: High school diploma GED or equivalent. Attach copies of any applicable certifications or licenses that you may hold.
  • On-the-Job Training: Attach copies of current employer's training records listing job-specific training provided and dates completed.
  • Work Experience: One or more years paid experience, attach dates, name(s) of employer(s), and addresses. Training must have been supervised by a licensed exemptee, Pharmacist-In-Charge or equivalent.
  • Training Programs: Indicate by yes or no the training you have completed specific to the five topics listed. Attach copies of certificates or transcripts.
Especially watch out for the Work Experience requirement.

"The HMDR Program is a CDPH program mandated by Assembly Bill 1496 of the 1999-2000 legislative session. This Program licenses all California and Out-of-State facilities and businesses who supply medical devices or durable medical equipment for use in the home to treat acute or chronic illnesses or injuries.
