"In “Optimizing Home Oxygen Therapy: An Official American Thoracic Society Workshop Report,” 26 physicians, nurses, respiratory therapists, patients and representatives of the Centers for Medicare and Medicaid (CMS), oxygen suppliers, the Food and Drug Administration and patient advocacy groups detail the shortcomings of the current system of providing supplemental oxygen to 1.5 million adults living in the United States. 
The panel was unanimous in its finding that delivery of home oxygen services has worsened since the onset of CMS’s Competitive Bidding Program nearly a decade ago. 
The workshop authors reviewed available scientific oxygen studies and results of a 2017 survey of nearly 2,000 supplemental oxygen users conducted by the ATS Nursing Assembly."

Most Medicare Claims for Replacement Positive Airway Pressure Device Supplies Did Not Comply With Medicare Requirements - DHS OIG (PDF - click this link)

"Most Medicare claims that DME suppliers submitted for replacement PAP device supplies did not comply with Medicare requirements. Of the 110 claims in our sample, 24 complied with Medicare requirements; however, 86 claims with payments totaling $13,414 did not. On the basis of our sample results, we estimated that Medicare made overpayments of almost $631.3 million for replacement PAP device supply claims that did not meet Medicare requirements."

The CMS expressed interest in educating health care providers on avoiding Medicare billing errors.

"Report findings show that more than 40% of the 146 suppliers examined did not meet licensure requirements and were incorrectly awarded contracts by CMS due to database inaccuracies. An additional 14 of the examined suppliers still require further research by CMS to determine whether they have met the necessary licensure requirements. These database deficiencies and inaccuracies were attributed to complex variations in state licensure requirements and the challenges that CMS has faced in maintaining a current and accurate database."

According to KGO-TV's Michael Finney, "An alarming number of senior care providers in people's homes have felony convictions."

His news report is important for the following highlights:
  • Background checks conducted by the state under a new law passed last year have found nearly 1,000 convicted felons working or seeking jobs as caretakers for seniors and disabled in California.
  • Anybody can go out and call themselves a home care worker, put an ad in the paper, and they're not required to have a criminal background check, 
  • In 2008, the Legislature passed a law that provides at least some protection, but little is done to enforce it.
