According to the California Board of Pharmacy, "To be licensed as a Designated Representative - 3PL in California, you must satisfy the requirements under Business and Professions Code section 4053.1. Each place of business of a third-party logistics provider shall be supervised and managed by a responsible manager. The responsible manager shall be responsible for the compliance of the place of business with state and federal laws governing third-party logistics providers and with the third-party logistics provider’s customer specifications, except where the customer’s specifications conflict with state or federal laws. The responsible manager shall maintain an active license as a designated representative-3PL with the board at all times during which he or she is designated as the responsible manager."

According to this SeekingAlpha.com article,  Cardinal Health sued over alleged fraudulently obtained contracts:

"UPPI, a group of small businesses producing radiopharmaceuticals, has filed litigation in a Washington court against drug wholesaler Cardinal Health (NYSE:CAH) and two of its front companies and owners claiming it fraudulently obtained U.S. Veterans Administration (VA) contracts."


"The largest association of independent nuclear pharmacies in the U.S. is accusing Cardinal Health (CAH), a major pharmaceutical wholesaler, of using front companies to win government contracts that are usually set aside for small businesses owned by disabled military veterans."

According to the Board, "To be licensed as a Designated Representative in California, you must satisfy the requirements under Business and Professions Code section 4053. Wholesale operations that distribute dangerous drugs or dangerous devices must be supervised by a registered pharmacist or an individual approved by the board as a designated representative. These companies may not operate unless the pharmacist or designated representative is physically on the licensed premises. To ensure proper control at all times, the board recommends that there be more than one person approved to supervise operations."

The Department is also committed to preventing hoarding and price gouging for critical supplies during this crisis.  To combat this misconduct, the President issued an Executive Order pursuant to section 102 of the Defense Production Act, which prohibits hoarding of designated items, and Attorney General Barr has now created the COVID-19 Hoarding and Price Gouging Task Force.  In a memo to U.S. Attorneys, Attorney General Barr said, “we will aggressively pursue bad actors who amass critical supplies either far beyond what they could use or for the purpose of profiteering. Scarce medical supplies need to be going to hospitals for immediate use in care, not to warehouses for later overcharging.”

New Licenses Required For Third-Party Logistics Providers (3PLs)


Read the full article, "New Licenses Required For Third-Party Logistics Providers (3PLs)," recently published in the Winter 2015 edition of The Script - by the California State Board of Pharmacy (PDF):

"Companies that do not own, but receive, store, select and ship prescription drugs and prescription devices into or within California need to obtain a third-party logistics provider (3PL) license immediately with the California State Board of Pharmacy.

Federal legislation enacted in November 2013 directed that 3PLs must be regulated as a separate class and not as a drug wholesaler."

AB 2605 (a new law):
  • "Creates a new licensure class of 3PLs and nonresident 3PLs for those businesses that do not own, but receive, store and ship prescription drugs and prescription devices;
  • Creates a new licensure class of “designated representative-3PL” for individuals who work in the 3PLs and possess the knowledge and experience necessary to be responsible for the quality of stored and shipped prescription items on a 3PL premises; and
  • Creates a new qualifying category of licensure for a responsible manager called “designated representative-3PL,” who acts as the facility manager and representative in charge of the 3PL."

""This is a sham," said Joel Marx, chairman of the board at AAHomecare and chairman of Medical Service Company in Cleveland.  He said the malfunctioning system also encourages "suicide low bids" by companies desperate to win contracts.  In fact, 244 economists, more than two dozen consumer and disability groups, 186 members of Congress, and the National Federation of Independent Business have opposed the current bidding system.

"By limiting which companies can provide the products and services, CMS can arbitrarily select prices as low as it wants and call it savings," said Marx. "This is not competitive bidding and there is no guarantee that the winning bidders can actually supply the products and services at the prices selected by CMS.""

Section 111656.3 starts out with:  
"Each home medical device retail facility shall have written policies and procedures related to home medical device handling and, if authorized by the department pursuant to Section 111656.4, the dispensing of prescription devices. Those written policies and procedures shall be adequate to assure compliance with this article and shall include, but not be limited to . . . "  
Notice the phrase, " . . . shall have written policies and procedures . . . "

Florida Cracks Down On Miami DME Fraud

The Miami Herald reports, Florida probes Miami-area medical-equipment kickbacks - Medicaid investigators are targeting fraud in Miami-Dade County, zeroing in on questionable billing for medical equipment. They report investigations of providers suspected of bilking the state healthcare program for low-income people by billing for oxygen concentrators that are not medically needed. Investigators also visited more than 120 Medicaid patients, some of whom may have received kickbacks from medical equipment suppliers for ordering their products. Of note, investigators indicate that unnecessary billing for oxygen concentrators has been a particular problem over the past five years. According to Holly Benson, secretary for the Florida Agency for Health Care Administration, said fraudulent billing for oxygen concentrators is the latest scam ailing Medicaid, which spent $90 million on medical equipment in fiscal 2007-08. About 25 percent of that spending, funded by state and federal taxes, was in Miami-Dade. In summary, it's especially important to have things in order if you're near Miami and billing for oxygen concentrators.
